Being an employer, failed to provide measures to prevent, as far as was practicable, the use of plant, namely a chip conveyor, in a manner that could render that plant a hazard to a person at the workplace.

Background Details

The defendant operates a timber mill in Pemberton. On the 12 October 1998 an employee of the defendant was inspecting the chain sprocket drive mechanism of a chip conveyor. The mechanism was not fitted with a guard.

The employee was injured when his right arm came into contact with the drive. At the time of the accident the chain sprocket was as shown in the photograph.

The defendant pleaded guilty.
