Being an employer at a workplace, failed to ensure that a person was not lifted or suspended by plant at a workplace, namely a forklift truck, or its attachment, which was not plant specifically designed for the lifting or suspending of persons.

Background Details

The defendant operates a freight transport company in Canning Vale. During a workplace inspection, a WorkSafe Inspector observed an employee driving a forklift which had a pallet attached to the tynes, and observed another employee climb onto the pallet and saw the forklift driver lifting the second employee, up to a height of approximately 3 metres.

The defendant was convicted in absence, pursuant to section 136AA of the Justices Act 1902.
