Did class 3 demolition work, namely the removal of asbestos cement roofing from a building, without being issued with a licence under the Occupational Safety and Health Regulations 1996 to do class 1, class 2 or class 3 demolitions work.

Background Details

The defendant successfully tendered for a project to remove and replace an asbestos roof from a building in Albany.

On 9 and 10 January 2002 a WorkSafe Inspector attended the site and found that the roof of the main building had recently been replaced with new colourbond roofing material and also found large bundles of asbestos cement roofing material wrapped in polyeutherene.

The defendant has never held a demolition licence issued by WorkSafe.

The defendant entered no plea and was convicted in absence pursuant to section 136AA of the Justices Act.
