The defendant operated a hay supply business in Brookton. On 11 July 2002 an employee was operating a hay bailing machine and became caught in the moving parts of the machine, resulting in fatal crush injuries to her head and shoulders. WorkSafe Inspectors attended the site and observed that the machine was not guarded in that there were no barriers to prevent employees from having access to the operating area of the machine. Full panel covering and guarding was subsequently installed. The matter originally commenced in the Pingelly Court of Petty Sessions, and subsequently transferred to the Perth Court of Petty Sessions for hearing and sentencing. The defendant pleaded guilty. |
