Being the main contractor in relation to a construction site where construction work was being carried out that exceeded a height of 6 metres above ground level, failed to ensure that there was displayed at the main entrance to the site a safety warning sign bearing the words "SAFETY HELMET AREA. SAFETY HELMETS MUST BE WORN AT THIS SITE".
This charge relates to the prosecution against Toscana (WA) Pty Ltd whereby they failed to provide and maintain a system of work designed to reduce the risk of employees falling whilst working at a height of over 6 metres above ground level. It was submitted that employees should have been provided with scaffolding or another type of working platform to reduce the risk of falling whilst working at a height of over 6 metres above ground level.
The defendant pleaded not guilty.
