During the construction of a two storey residential dwelling the employer failed to provide adequate scaffolding. There were a number of workers at a height of approximately 5.5metres above the ground with the risk of falling. It was practicable for the defendant to place temporary handrails, midrails and kick boards on the scaffolding, to secure the ladder used to access the scaffolding and to place bracing struts on the scaffolding, due the risk of falling from the scaffolding, being hit by objects falling from the scaffolding, or from the scaffolding collapsing. The defendant pleaded guilty.
