Being a person who had control of a workplace where persons who were not his employees worked, failed to take such measures as were practicable to ensure that the workplace was such that persons who were at the workplace were not exposed to hazards.

Background Details

The defendant was constructing 5 multi-storey residence in Melville.

During an inspector's inspection of the site a number of hazards and breaches were identified such as:
* unsafe access/egress to working platforms of scaffold and first floor slab areas, (the photograph is an example of this hazard).
* Unguarded stairwells.
* Debris scattered over the site, in access ways and on working platforms.
* Scaffold planks spanning between units and erected on handrails of scaffold.
* Missing edge protection on scaffold.
* Missing scaffold planks/incomplete working platforms.
* Drums used as scaffold.
* Open edges from fixed platforms and stairways.

The defendant pleaded not guilty. The penalty was imposed under section 22(4).
