| Background Details |
An inspector issued an improvement notice on the defendant on 1 July 1997 because he formed the opinion that a drain along the side of the road and beside the freezer, created an overturning hazard for the forklift being operated in the area. The notice required the hazard to be rectified by 26 August 1997. Three months after the expiry of the notice the inspector revisited the site and observed that the hazard had still not been addressed. The defendant pleaded not guilty. The penalty was imposed under section 54(b). |
