Prosecution Details

Being a self employed person at a workplace, failed to ensure that work involving the use of asbestos cement building materials at the workplace was done in accordance with Section 9 of the Code of Practice for the Safe Removal of Asbestos [NOHSC: 2002 (1988)].

The defendant (and his partner Trevor Gowing - who is also the subject of prosecution action) were contracted to demolish an asbestos cement clad house in Carlisle.

Their workers were not wearing the appropriate personal protective equipment and the asbestos cement cladding was being broken into pieces and left scattered around on site. The site was not fenced and no signage indicating removal of asbestos cement sheeting was in progress.

The defendant pleaded not guilty.
