Being an employer failed, so far as was practicable, to provide and maintain a working environment in which its employees were not exposed to a hazard.

Background Details

The defendants employees were working on the top of an awning at a hotel in Perth where no edge protection was provided as shown in the photograph and were not wearing any fall arrest equipment.

There was a static line in place over the full length of the awning but the roof plumbers were not wearing safety harnesses and attached to the static line to prevent them from falling to the ground. The awning was approximately 3000mm wide and 6000mm above the ground.

The case was heard by Her Worship Ms Bennett-Borlase SM.

The defendant pleaded not guilty. The penalty was imposed under section 19(6).
