Being an employer, failed to provide measures to prevent, as far as was practicable, the use of plant, namely a band saw, in a manner that could render that plant a hazard to a person at the workplace.

Background Details

The defendant operates a cabinet making business. The premises were inspected on 5 March 1999. Upon inspection it was observed that a band saw was not fully guarded, amongst other breaches of the legislation.

This was not the first time that this company had been the subject of enforcement action by inspectors with the department. In fact this bandsaw had been the subject of a prior prohibition notice.

The picture shows the wheel below the table of the bandsaw and the lack of an adequate guard. The upper wheel, also lacked guarding.

A notice was issued to the defendant in relation to the lack of guarding to the band saw and others were issued in relation to other breaches at the workshop.

The case was heard by His Worship, Mr Heath SM. The defendant pleaded not guilty.
