On 20 July 1999 the defendant was undertaking bricklaying work at a construction site in East Perth. During a routine inspection, an employee of the defendant was found working on an unsafe work platform completing bricklaying work to the gable of a two storey unit. The employee was exposed to the risk of falling from a height of 2.4 metres.
It was practicable for the defendant to have provided a scaffold with edge protection in the form of guard rails to ensure that the work platform used by its employee was safe.
The defendant pleaded guilty. The penalty was imposed under section 19(6).
