Background Details |
The defendant was contracted to supply and fix the roof mesh, roof sheets and box gutters for a factory/warehouse in Wangara. The defendant then subcontracted the fixing of the roofing material to another person. The subcontractor and his assistanct were exposed to the hazard of falling off the roof whilst attaching roof safety mesh. The roof was approximately 6 metres high. An inspection of the site revealed that the defendant made inadequate provision for protecting persons from falling off the roof. There were no anchor points or static lines on the roof to anchor to. It was practicable for the defendant to have provided a safe system of work for persons fixing the roof materials on their behalf. The defendant pleaded guilty. The penalty was imposed under section 19(6). |
