|Description of Breach(es)||
Being an employer, failed to ensure that the guard provided to the "Muhr U Bender" was kept in position while the plant was operated.
At the time of the accident on 2 July 1996 the injured employee was in the process of cutting a flat bar and whilst doing so placed his right hand inadvertently on the bed of the notcher. When he activated the foot pedal the flat bar was cut and simultaneously the notcher came down and removed the tip of his right index finger, below the nail. The notcher was fitted with a guard but someone had wired it in the up position leaving the moving part exposed.
