Did class 3 demolition work, namely the removal of asbestos cement roofing from a building, without being issued with a licence under the Occupational Safety and Health Regulations 1996 made under the Occupational Safety and Health Act 1984 to do class 1, class 2 or class 3 demolition work.
The Defendant was engaged to remove and replace an asbestos roof which covered a set of four units located in Girrawheen. The building consisted of four single storey units in a row. The roof was a split-level structure where the roof cladding was continuous in respect of two units and then continued at another level in respect of the remaining two units.
On 8 November 2001 the defendant applied for an exemption from the Commissioner from the requirement to hold the relevant demolition licence. The application was refused. Sometime between the 13 and 30 November 2001 two employees of the defendant removed the asbestos roof.
The defendant pleaded not guilty.
