Being a self employed person failed to ensure that class 2 demolition work to be done at the workplace was done by a person who has been issued with a licence to do class 1 or class 2 demolition work.
The defendant was engaged by another company to demolish a factory and office site in O'Connor. The defendant engaged a subcontractor to do the work. The building was approximately 80m by 20m and was 6m high.
A WorkSafe Inspector inspected the site and found broken asbestos cement building materials, stacks of roof timber, broken concrete and roof steel scattered about the site. A search of WorkSafe records revealed that neither the defendant nor the subcontractor held the necessary demolition licence to carry out the work.
The defendant was convicted in absence, pursuant to section 136AA of the Justices Act 1902.
