Being the employer of a person who suffered an injury as a result of an accident occurring at a workplace on 6 September 1995, which injury was of a kind prescribed in regulation 201(1)(e) of the Occupational Health, Safety and Welfare Regulations 1988, made under the Occupational Health, Safety and Welfare Act 1984, failed to notify the WorkSafe Western Australia Commissioner forthwith of the accident.
The injured person was employed as a picklier, which involves the galvanising of metal products. On the day of the accident he was walking along a 30 to 40cm wide edge of the caustic tank assisting another person in carrying a metal handrail. The handrail was to be placed in the caustic tank. He lost his balance and fell into the tank.
As a result of falling into the tank he received caustic burns to both legs and was hospitalised for 6 weeks and off work for a further 3 weeks. This accident was not reported to WorkSafe.
The Magistrate took into account the early guilty plea and cooperation by the defendant and that there was no intent to evade legislative duties.
