Being an employer, failed, so far as was practicable, to provide and maintain a working environment in which its employees were not exposed to hazards in that it failed to provide and maintain the workplace such that, so far as was practicable, its employees were not exposed to a hazard.

During the construction of a gymnasium and assembly hall at Mercy College Koondoola the employer failed to provide and maintain edge protection on a mezzanine. This failure resulted in a 20 year old brush hand falling and receiving head injuries.

The Court found that it was practicable for the employer to place temporary guard rails at the mezzanine's open edges.

A not guilty plea was entered.
