 Being an employer, failed, so far as was practicable, to provide and maintain a working environment in which one of its employees, was not exposed to hazards and by that failure caused serious injury.
 Being an employer, failed forthwith to notify the Commissioner in the form prescribed by Regulation 201 of an accident at its workplace that resulted in injury to one of its employees, such injury having appeared likely to result in the employee being absent from his employment for 10 days or more.
A casual staff member of the employer, was using an occy strap to collect trolleys. As he was pulling the occy strap tight it came away from the trolley and hit him in the eyes. The injured employee lost 50 % vision in his left eye.
The Magistrate during sentencing comments indicated that this incident pre-dated the death of a child in Karratha arising from the use of an occy strap for similar purposes.
A not guilty plea was entered.
